The Motorcycle Helmet Act of 2009 or RA No.10054 provides that all motorcycle riders, including drivers and back riders, shall at all times wear standard protective motorcycle helmets while driving, whether long or short drives, in any type of road and highway.
Penalty for riding a motorcycle without a helmet
Failure to wear the standard protective motorcycle helmet or failure to require the back rider to wear the standard protective motorcycle helmet will subject the violator to the following penalties:
- 1st offense – Php1,500.00
- 2nd offense – Php3,000.00
- 3rd offense – Php5,000.00
- 4th and succeeding offenses – Php10,000
Aside from the fine, a 4th and succeeding offenses will also carry the penalty of confiscation of the violator’s driver’s license.
